Several states exempt most telemarketers from registration / telemarketer licensing, if no prize promotions are used. These states include: Arkansas, California, Indiana, Louisiana, Nevada, Oregon, and Rhode Island.

On the other hand, many states have additional telemarketing rules for telemarketers who use prize promotion. A prize promotion includes incentives such as sweepstakes and giveaways, etc.  Many state telemarketing license applications require more information from telemarketers who use prize promotion, and may require greater telemarketing bond amounts.
